he bulls may be slowly losing their grip on Wall Street as Dow tumbled 107 points on Tuesday -- capping its worst two-day slide in nearly three months -- amid sinking energy stocks and an ugly day for the retail sector.

    Today's Markets

The Dow Jones Industrial Average lost 107.46 points, or 1.25%, to 8504.67, the Standard & Poor's 500 sank 11.75 points, or 1.27%, to 911.97 and the Nasdaq Composite tumbled 20.20 points, or 1.11%, to 1796.18. The consumer-friendly FOX 50 fell 9.42 points, or 1.38%, to 675.39.

Tuesday's triple-digit tumble came in the face of a pair of better-than-expected economic reports that showed an unexpected surge in new home construction and the largest annual decline in producer prices in 60 years. Instead, the markets closed sharply lower as oil's $2 rally evaporated and retailers soured on Best Buy's (BBY: 35.67, 0, 0%) earnings report.

“The disturbing thing is they look a little tired to me. The kind of [economic] news we had this morning… if that happened a week ago, the market would have been up 200 points. I think we’ve run into this wall,” NYSE trader Ted Weisberg of Seaport Securities told FOX Business, pointing to the 9000 level on the Dow as a major point of resistance.

Stocks ended at session lows, with the Dow losing roughly 50 points in the final 10 minutes alone. The index has lost nearly 300 points this week alone -- the worst two-day slide since March 30. The ugly start to the week drags the index back into the red for 2009 and leaves Wall Street's four-week win streak in doubt.

“I think the market is starting to deteriorate here. It really needs to turn course quickly or we could have a healthy correction with the Dow returning to late-May lows,” said Nick Kalivas, director of financial research at MF Global.

Last week the bulls put the finishing touches on a 14-week surge that pushed the Dow up nearly 33% -- the biggest such move since March 1975. But Kalivas said if the benchmark index is unable to hold the 8500 level, it could sink down to 8250.

Nearly all 30 stocks on the Dow ended with losses, led by Bank of America (BAC: 12.739, n.a., n.a.%), General Electric (GE: 12.76, 0, 0%) and Disney (DIS: 23.49, 0, 0%). On the upside, Microsoft (MSFT: 23.45, 0, 0%) and Pfizer (PFE: 14.16, n.a., n.a.%) eked out minor gains.

Energy stocks like ExxonMobil (XOM: 71.61, n.a., n.a.%) and Schlumberger (SLB: 56.87, n.a., n.a.%) dragged the markets lower as crude closed in the red for the third-straight day. After nearly eclipsing $73 per barrel early in the day, crude settled at $70.47, down 15 cents, or 0.21%. Gold held onto its gains, climbing $4.70 per ounce, or 0.51%, to $931.60.

At the same time, retailers like Abercrombie & Fitch (ANF: 25.78, 0, 0%) and J.C. Penney (JCP: 26.35, 0, 0%) sold off following Best Buy's better-than-expected earnings report. While the electronics retailer beat the Street with a 15% decline in net income, it declined to boost its full-year outlook, citing "limited visibility to consumer spending in the back half of the year." The comments helped send Best Buy's shares down nearly 8%.

Meanwhile, Kevin Warsh, a Federal Reserve governor, warned that just because stocks have surged off their lows doesn’t mean the U.S. economy will follow suit. "The panic's hasty retreat should not be confused with robust recovery," said Warsh. “The rather indiscriminate bounce off the bottom -- across virtually all assets and geographies -- may be more indicative of a one-time reset, which may or may not be complete."

    Data Dump

Despite recent inflation fears, the Labor Department said Tuesday its produce price index climbed just 0.2% in May, a softer read on inflation than the 0.6% increase expected by economists. In fact, prices were off by 5% from a year ago, the largest annual decline in 60 years. Excluding volatile food and energy costs, prices were down 0.1% from April -- the first decline in nearly three years.

The Commerce Department said housing starts surged by 17% last month from April’s record low -- more than twice as much as economists expected. Single-family housing, a key indicator of demand in the struggling housing market, rose for the third-straight month. Home-building stocks like Centex (CTX: 8.36, 0, 0%) and Lennar (LEN: 7.73, 0, 0%) closed modestly higher.

    Corporate Movers

General Motors unveiled plans to unload its unprofitable Saab unit to Swedish boutique auto maker Koenigsegg Group for an undisclosed sum. Separately, CEO Fritz Henderson told The New York Times that GM plans to reduce its executive ranks by 35% from last year.

La-Z-Boy (LZB: 4.35, 0, 0%) surged by almost 20% a day after the furniture maker surprised the Street with an adjusted-profit of 7 cents per share. Analysts had expected an 11-cent loss for the company, which suffered a 23% plunge in revenue.

News Corp.’s (NWS: 10.73, 0, 0%) social-networking site MySpace released plans to slash its staff by 30% to reduce “bloated” staffing levels. Rupert Murdoch’s News Corp. is also the parent of FOX Business.

BlackRock (BLK: 169.92, 0, 0%) said its deal to buy Barclays Global Investors from Barclays (BCS: 17.6699, 0, 0%) has been accepted by the British lender and will close in the fourth quarter.

Matrixx Iniatives (MTXX: 5.78, 0, 0%) lost more than two-thirds of its market cap after the FDA told the drug maker to stop selling the intranasal versions of its cold medicine Zicam due to 130 reports of people losing their sense of smell. While Matrixx called the FDA action “unwarranted,” it said it may remove the products from the marketplace.

Genzyme (GENZ: 52.75, 0, 0%) tumbled after the biotech company said it will stop production at a Boston plant after finding a virus there. The halt will impact two of the drug maker’s best-selling drugs.

Sara Lee (SLE: 8.78, 0, 0%) is blocking private-equity firms, including Blackstone Group (BX: 11.17, 0, 0%) and Kohlberg Kravis Roberts, from taking part in the auction of its household and personal-care business, the New York Post reported. Goldman Sachs (GS: 144.11, 0, 0%), the investment bank in the auction, is reportedly requiring suitors to bid for the entire division.

    Global Markets

    European stocks were mixed following a two-day dive. London's FTSE 100 gained 0.06% to 4328.57, Germany's DAX climbed 0.02% to 4890.72 and France's CAC 40 slid 0.17% to 3213.95.

In Asia, Japan's Nikkei 225 slumped by 2.86% to 9752.88 and Hong Kong's Hang Seng fell 1.8% to 18165.50. China's Shanghai Composite sank 0.48% to 2776.02.

  22. Split Decision for Stocks: Dow Flatlines, Nasdaq Climbs

he markets closed with a mixed verdict on Wednesday as the Nasdaq Composite’s two-day slide was brought to an end but a recovery in oil prices wasn’t enough to stop the bleeding in the broader indexes.

    Today’s Markets

The Dow Jones Industrial Average slid 7.49 points, or 0.09%, to 8497.18, the Standard & Poor's 500 sank 1.26 points, or 0.14%, to 910.71 and the Nasdaq Composite picked up 11.88 points, or 0.66%, to 1808.06. The consumer-friendly FOX 50 fell 1.90 points, or 0.28%, to 673.49.

The mixed finish for Wall Street comes as the bears appear to have regained some control of the markets amid concerns stocks have risen too far, too soon.

“After the two days of weakness, the sentiment shift is pretty palatable. The tone has turned bearish. There’s no doubt about it. In the last few days it’s sort of reared it’s ugly head,” said Frank Davis, director of sales and trading at LEK Securities.

Aside from the volatile price of crude oil, the markets lacked much direction on Wednesday. Wall Street had a muted response to another tame inflation report, disappointing guidance from FedEx (FDX: 50.64, -0.76, -1.48%) and the unveiling of the White House’s regulatory overhaul.

“I would say this market the entire week has been driven by oil prices,” said Art Hogan, chief market strategist at Jefferies & Co. “I don’t think we’ve reached that magic point of commodity prices affecting consumer spending yet. But at some point in time, we’ll say it’s seriously become a drag on spending.”

The bulls have taken a back seat this week as the Dow has tumbled nearly 300 points in a pair of selloffs -- the worst two-day slide since March 30. The losses haven’t been sparked by any new groundbreaking developments, rather traders have said stocks have run out of momentum after their largest 14-week surge in more than three decades.

  23. [2ον]

Some have questioned if this is the beginning of the long-awaited correction from recent highs.

“If the bears are happy with being down 4% in three days after being up 40% in three months, god bless them,” said Hogan. “Unfortunately everyone is talking about ‘too far, too fast.’ I would say the more we pull back, the more bullish we’re going to get here because we have all of this money on the sidelines. No one is going to wait for a 15% pullback.”

The Dow was led higher Wednesday by Pfizer (PFE: 14.59, 0.43, 3.04%) and Home Depot (HD: 23.65, 0.47, 2.03%). The index's biggest percentage losers included General Electric (GE: 12.24, -0.52, -4.08%) and Alcoa (AA: 10.45, -0.44, -4.04%).

Thanks to solid gains for tech stocks like Adobe (ADBE: 28.68, 0.51, 1.81%) and a rally in the bio-tech sector, the Nasdaq Composite closed solidly higher, its first gains since Friday.

Crude's $2 rally off the lows Wednesday wasn't enough to carry the Dow to a positive finish. Still, energy stocks pared their losses as crude avoided extending its three-day slump by settling at $71.03 per barrel, up 56 cents, or 0.79%. The rally came in the face of a new government report that revealed an unexpected surge in gasoline inventories.

Financial stocks were the biggest drags on the markets after Standard & Poor's cut its credit ratings on a slew of banks, including Wells Fargo (WFC: 23.1, -1.32, -5.41%), U.S. Bancorp (USB: 17.75, -0.12, -0.67%), Key Corp. (KEY: 5.44, -0.47, -7.95%) and Fifth Third Bancorp (FITB: 6.81, -0.39, -5.42%). The ratings company warned of increased risks due to a transition period for the industry.

The selloff came even as several major banks officially repaid their bailout cash on Wednesday, including JPMorgan Chase (JPM: 32.74, -0.73, -2.18%), Morgan Stanley (MS: 27.43, -0.68, -2.42%) and BB&T (BBT: 21.56, -0.76, -3.41%).

Meanwhile, stocks didn't appear to be fazed by Washington, where President Barack Obama unveiled the most sweeping financial regulatory overhaul since the Great Depression. The administration wants to give vast new powers to the Federal Reserve, make the Office of Thrift Supervision disappear and create a new consumer protection agency. If the markets believe the approach is too heavy-handed, it could prove to be a new headwind for stocks.

    Data Dump

Wall Street had a muted reaction to a second-straight inflation report that seemed to indicate inflation isn't a near-term problem for the economy.

The Labor Department said Wednesday consumer prices rose by just 0.1% last month, well shy of the 0.3% increase economists expected. Excluding food and energy, prices rose an in-line 0.1%. However, prices were off by 1.3% from a year ago -- the largest annual decline since April 1950.

    Corporate Movers

FedEx (FDX: 50.64, -0.76, -1.48%) beat the Street with an adjusted-profit of 64 cents per share but warned there isn’t “enough visibility into the economic recovery and jet fuel prices to provide a meaningful annual earnings forecast.” FedEx sees earnings in the range of 30 cents to 45 cents per share for the current quarter, compared to the Street’s view of 70 cents.

NRG Energy (NRG: 22.68, -0.09, -0.4%), Southern Co. (SO: 30.35, 0.24, 0.8%), Scana (SCG: 31.34, 0.3, 0.97%) and Unistar Nuclear Energy are expected to split $18.5 billion in federal financing to build the next generation of nuclear reactors, The Wall Street Journal reported. It’s believed those four energy companies beat out Exelon (EXC: 48.48, -0.42, -0.86%) and Entergy (ETR: 76.26, -0.26, -0.34%), two of the industry’s leaders in nuclear energy.

Eddie Bauer (EBHI: 0.18, -0.05, -21.74%) filed for Chapter 11 protection and unveiled a deal to be acquired by private-equity firm CCMP Capital Advisors.

Savient Pharmaceuticals (SVNT: 12.55, 3.29, 35.53%) surged by more than 30% after an FDA panel recommended greenlighting its experimental gout drug for certain patients. The agency is expected to rule on the arthritis drug Krystexxa by August 1.

Star Scientific (STSI: 1.13, -3.08, -73.16%) lost almost three-quarters of its market cap after the tobacco company lost a patent suit with Reynolds American (RAI: 37.17, 0.82, 2.26%). Star had sought several hundred million dollars in damages after saying Reynolds used Star’s new method to lower cancer-causing toxins in tobacco.

Adobe (ADBE: 28.68, 0.51, 1.81%) reported an in-line adjusted-profit of 35 cents per share and a slightly better-than-expected revenue forecast for the current quarter. However, the maker of Photoshop software said its profit margin fell 3% to its worst level in three years.

E*Trade Financial (ETFC: 1.46, -0.19, -11.52%) tumbled 11.5% after the online brokerage unveiled plans to sell common stock and exchange debt in an effort to raise $1.2 billion. The moves could dilute current shareholders by 40%.

Netflix (NFLX: 40.4, 2.57, 6.79%) rose sharply after the DVD rental service was upgraded to “buy” from “hold” by Wedbush Morgan on valuation, the fourth upgrade for the company since March.

    Global Markets

    London's FTSE 100 fell 1.16% to 4278.46, France's CAC 40 fell 1.64% to 3161.14 and Germany's DAX sank 1.86% to 4799.98.

In Asia, Japan's Nikkei 225 gained 0.9% to 9840.85, Hong Kong's Hang Seng tumbled 0.45% to 18084.60 and China's Shanghai Composite jumped 1.23% to 2810.12.

  25. Obama Touts Financial-Regulation Proposals

President Obama said his Administration's proposals for financial-regulatory reform are meant to promote market innovation and long-term economic health without allowing for abuse.

The Administration’s proposals need to be implemented quickly, senior Administration officials said Tuesday evening in a discussion of the plans that include abolishing the Office of Thrift Supervision and creation of a financial consumer-protection agency.

An official said that the proposals would be sent to Capitol Hill imminently, adding that “the costs of inaction are apparent.” Indeed, the Administration released more details on the proposal to Congress with the distribution of an 85-page white paper. See the paper at the bottom of this story.

Much of the information about the proposals and the Administration’s five key elements to reform had already come out.

    Those five elements are:
    --Strong oversight of financial firms.
--Strengthening the regulation of core markets and infrastructure.
    --Strengthen consumer protection.
--Ensure the government has the tools to effectively manage financial crises.
--Ensure high standards, not just in the U.S. but also globally.

The Office of Thrift Supervision will be abolished and taken under the Office of the Comptroller of the Currency, which will be renamed the “National Bank Supervisor,” an official said. That official added that the thrift charter would be eliminated to “eliminated the possibility for arbitrage between federal charters.”

The officials said a financial-services oversight council would be created, and chaired by the Treasury Department. They said firms would face higher capital requirements and higher scrutiny.

The Federal Reserve is slated to serve as the supervisor at the holding-company level.

Also, there would be a “fundamental reassessment of the design and structure of regulatory capital requirements.” Hedge funds and other private pools of capital would be regulated.

The Administration is seeking “appropriate” regulation of derivatives, credit-default swaps and other securities, and wants to make sure the securities “are not marketed incorrectly to unsophisticated parties.”

The Administration will also call for “a new, strong, independent agency with full authority to protect consumers from unfair practices.”

The consumer agency would not have authority over products regulated by the Securities and Exchange Commission, but instead the SEC and that agency would coordinate, which the Administration anticipates “will keep both agencies strong and focused on their core mission.”

All big firms would have to have a plan for orderly resolution to “reduce the impact of failure,” an official said.

Also, the U.S. will work “to make sure there are high standards, not just in the United States but globally,” the official said, adding that the government would continue to work with the G-20, Basel committee and the entire international community to make that happen.

Officials said they “have not done a detailed cost estimate” of the changes.
